This license does not include any resale or commercial use of the Service or its contents; any collection and use of any Tool listings or descriptions; any derivative use of the Service or its contents; or any use of data mining, robots, or similar data gathering and extraction tools. All rights not expressly granted to you are reserved by BravurApp.com.

You retain any rights you hold in the User Content you submit. However, by submitting User Content to the Service, you grant BravurApp.com a worldwide, non-exclusive, royalty-free license to use, process, and display that User Content solely for the purpose of providing the Service to you. This license terminates when you delete the User Content from the Service or your account.

5. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall BravurApp.com, its officers, directors, employees, or agents, be liable to you for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

Our total cumulative liability to you for all claims arising from or related to the Service shall not exceed the amount of one hundred US dollars (USD $100.00). Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

BravurApp.com makes no warranty that (i) the Service will meet your requirements, (ii) the Service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the Service will be accurate or reliable, and (iv) the quality of any products, services, information, or other material obtained by you through the Service will meet your expectations.

No advice or information, whether oral or written, obtained by you from BravurApp.com or through the Service shall create any warranty not expressly stated in these Terms.

7. Indemnification

You agree to defend, indemnify, and hold harmless BravurApp.com, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Service.

8. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

We may also, in our sole discretion and at any time, discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of these Terms may be effected without prior notice.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the state and federal courts located in King County, Washington, for the purpose of litigating all such claims or disputes.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
